Please read these Terms of Use carefully. This is a binding contract with TheBenefactor.net or otherwise stated TheBenefactor.net within this website.

Your use of TheBenefactor.net is subject to these terms, the Paid Services Terms, Privacy Policy and any Terms and Policies mentioned in the aforementioned documents. TheBenefactor.net offers certain paid services, which are subject to the TheBenefactor.net Terms of Sale, Paid Services terms as well as any additional terms or conditions that are disclosed to you in connection with such services. TheBenefactor.net allows you to discover and purchase content and connect with viewers with similar interests as well as content creators.

These terms of use apply to viewers whether they have a registered account with TheBenefactor.net or viewing the content on TheBenefactor.net as an unregistered user. We may revise these Terms of Use from time to time and the most current version will govern our Terms of Use Policy and will always be at 
TheBenefactor.net/terms-of-use If we make a change to these Terms of Use that, in our sole discretion, is material, we will notify you within TheBenefactor.net or by sending an email to the email address associated with your account from [email protected] By continuing to access or use our Services after those changes become effective, YOU AGREE to be bound by the revised "Terms of Use".

By clicking the “Sign Up” button and registering as a user on TheBenefactor.net, you are entering into a legally binding agreement between the content creator / user and TheBenefactor.net regarding your use of the TheBenefactor.net services.

Privacy

The privacy policy of TheBenefactor.net delays what data is collected and how it is used. Privacy is important to TheBenefactor.net and this document should be reviewed before registering an account with TheBenefactor.net

Use of TheBenefactor.net

TheBenefactor.net offers a wide range of content for all age groups including videos, audio ( for example music and other sounds ), graphics, photos, text ( such as comments and scripts ), branding ( including trade names, trademarks, service marks, or logos ), interactive features, software, metrics, and other materials whether provided by you, TheBenefactor.net or a third-party. It is recommended that viewers of TheBenefactor.net be at least 12 years of age however, the viewer must gain permission of an adult or guardian to view general content. If you are the legal guardian of a minor ( in your region ) wishing to view age-appropriate content on TheBenefactor.net, by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child's activity while on TheBenefactor.net.

Content is the responsibility of the person or entity that provides it to the Service. TheBenefactor.net is under no obligation to host or serve Content. If you see any Content, you believe does not comply with the Terms of Use, report the content to [email protected]

When viewing TheBenefactor.net or registering an account with TheBenefactor.net on behalf of a company or organization, you represent the following:

1. You have the authority to represent the company, organization or entity.
2. Agree to the terms of use on behalf of the company, organization or entity.

If a previous user has been banned from TheBenefactor.net, the user is forbidden from using TheBenefactor.net again.

Reservation

Using TheBenefactor.net does not give you ownership of or rights to any aspect of the platform, including user names or any other Content posted by others on TheBenefactor.net.

Accounts / Viewer

The viewer is solely responsible for maintaining the confidentiality of their account, their password and for restricting access to their computer. If the viewer permits others to use their account credentials, they agree to these Terms of Service on behalf of all other persons who use the Services under their account or password, and they are responsible for all activities that occur under their account or password. Please make sure the information the viewer provides to TheBenefactor.net upon registration and at all other times is true, accurate, current, and complete to the best of their knowledge. The viewer must not sell, rent, lease, share, or provide access to their account to anyone else, including without limitation, charging anyone for access to administrative rights on their account.

Viewers are to review the 
Paid Services Terms before using TheBenefactor.net. By registering with TheBenefactor.net, they accept the terms and policies associated with the platform.

Details of the Platform fees users can expect:

Platform fees will either be used for administrative, ongoing operation costs, marketing costs and sent to pay it forward rewards for platform users.

• Total Withdrawal Balance Fees: A 2% ( 2 percent ) withdrawal fee will be applied for users at withdrawal for ongoing platform operating expenses and also 1% ( 1 percent ) fee that will be sent to Pay It Forward Rewards that will get distributed equally to all users on the platform with enabled rewards activated.

• Platform Rewards Withdrawal Fee: A 3% ( 3 percent ) withdrawal fee will be applied for users at withdrawal and sent to Pay It Forward Rewards that will get distributed equally to all users on the platform with enabled rewards activated.

• Platform Lottery Fee: 20% ( 20 percent ) of lottery ticket purchases are subtracted and sent to Pay It Forward Rewards that will get distributed equally to all users on the platform with enabled rewards activated.

• Monthly subscription fees, tips, NFT purchases, optional Live-Streaming entrance fees and fees for premium posted content goes directly to that user in any such transaction.

• Every $4 Verified user fee gets sent directly to Pay it Forward Rewards.

• 20% ( 20 percent ) of banner advertising fees goes to Pay it Forward Rewards that will get distributed equally to all users on the platform daily with enabled rewards activated and the remaining 80% ( 80 percent ) goes to ongoing platform operating expenses.

• Donation Withdrawal Fee: 5% ( 5 percent ) withdrawal fee is applied to all donations and sent to Pay It Forward Rewards that will get distributed equally to all users on the platform with enabled rewards activated.

• P2P Token Transfer Fee: 0.1% ( 0.1 percent ) P2P token transfer fee will be sent to pay it forward rewards that will get distributed equally to all users on the platform with enabled rewards activated.

User's / Content Creators

1. Every User / Content Creator is bound personally by the Terms of Use.
2. The Content is not confidential, and you authorize your viewer to access and view your Content on TheBenefactor.net for their own lawful and personal use.
3. TheBenefactor.net is not responsible for and does not endorse any aspect of any Content posted by the content creators or any other User of TheBenefactor.net. TheBenefactor.net does not have any obligation to monitor any Content and have no direct control over what the posted Content may comprise.


4. You also agree to act as custodian of records for the Content that you upload to TheBenefactor.net.

Unacceptable Use

The content creator, post author, banner advertiser or viewer agree not to violate any laws, intellectual property or third-party rights. Most of all, the content creator and viewer agree to use TheBenefactor.net for purposes permitted in these terms. The content creator, post author, banner advertiser or viewer will not:

• Use TheBenefactor.net in any way that is in violation of any laws or regulations.
• Fail to comply with any of TheBenefactor.net terms or policies.
• Collect or harvest email addresses or other contact information of other viewers or content creators on TheBenefactor.net.
• Download any content without permission.
• Use or attempt to use another viewers account without authorization from that viewer and TheBenefactor.net.
• Post or upload includes or uses any third-party material, you have not secured all rights, licenses, written consents and releases that are necessary for the use of such third-party property in your Content and for the subsequent use and exploitation of that Content on TheBenefactor.net.
• Post, upload or share content or comments that are considered inaccurate, abusive, violent, damaging, threatening, racially or ethnically offensive, immoral, indecent, seditious, or intimidating or anything else TheBenefactor.net deems as inappropriate.
• Post, upload or share content or comments that are likely to cause embarrassment, annoyance, discomfort, distress, alarm, intimidation or anything else TheBenefactor.net deems as inappropriate.
• Post, upload or share content or comments that advertises, encourages, facilitates or solicits incest, sexual activity with minors, necrophilia, illegal prostitution, human trafficking, revenge porn, violent, kidnapping, rape, lack of consent, sexual abuse, torture, sexual assault, hardcore bondage, use of weapons, asphyxiation, mutilation or anything else TheBenefactor.net deems as inappropriate.
• Do not use TheBenefactor.net to be inconsiderate to others, stalk, bully, abuse, harass, threaten or intimidate anyone else.
• Send junk mail or spam to viewers or content creators of TheBenefactor.net, including without limitation promotional materials, unsolicited advertising, or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, petitions for signatures, or any of the preceding things related to promotional giveaways (such as raffles and contests) and other similar activities.
• Interfere with or damage the operation of TheBenefactor.net.
• Send unsolicited sexual content to another viewer content creator or otherwise engage in non-consensual sexual objectification.
• Use TheBenefactor.net to distribute unsolicited promotional or commercial content or other unwanted or mass solicitations.
• Engage in antisocial, disruptive, or destructive behavior.
• Circumvent, reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, except and only if applicable law despite this limitation expressly permits that activity.
• Manipulate identifiers in order to disguise the origin of any User Content transmitted through TheBenefactor.net.

These rules do not create any private right of action on the part of any third party or any reasonable expectation that TheBenefactor.net will not contain any content that is prohibited by such rules. TheBenefactor.net is not liable for any statements or representations included in User Content. TheBenefactor.net does not endorse any User Content, opinion, recommendation, or advice expressed therein, and TheBenefactor.net expressly disclaims any and all liability in connection with User Content as permitted by law, TheBenefactor.net takes no responsibility and assumes no liability for any viewer content or for any loss or damage resulting therefrom, nor is TheBenefactor.net liable for any mistakes, omissions, pornography, defamation, falsehoods, slander, libel, obscenity, or profanity you may encounter when using TheBenefactor.net. The viewer's use of TheBenefactor.net is at your own risk.

TheBenefactor.net reserves the right to remove, screen or edit any User Content posted or stored on TheBenefactor.net at any time and without notice where such User Content violates these Terms of Service or applicable law.

Account Deletion or Account Inactivity

If you, the account user, or account owner, deletes said account, all of its resources, content and data will be permanently deleted. No retrieval of any account information is possible after the account user or account owner deletes account. Immediately following a deleted account, all crypto assets or tokens in said deleted account will be transferred to all users pay it forward rewards accounts on the platform.

• If any user gains your login credentials and deletes your account: TheBenefactor.net may not be responsible for any said deleted user account only if the appropriate security measures are NOT acted upon which are enabling your 2FA ( Two Factor Authentication ) and Logout Other Browser Sessions that are not you, which are located in your profile Security Settings. TheBenefactor.net will send an account notification if any other browser session is logged in using your credentials and if you are not taking appropriate actions to delete other browser sessions and update password, TheBenefactor.net will not be responsible for any account deletion or the retrieval of any said account information.

• TheBenefactor.net will retain your full account for a period of up to 1 year for any administration regulatory reference deemed necessary, for any unlawful acts of any kind if needed by law enforcement.

Purchases and Payments

This section describes the terms that apply to Viewers / User's / Content Creators Transactions.

• All Viewer/Content Creator Transactions are contracts between Viewers and Content Creators on the terms of the Standard Contract between a Viewer and Content Creator. Although TheBenefactor.net facilitates the Viewer/Content Creator Transactions by providing the TheBenefactor.net platform and storing Content we are not a party to the Standard Contract between Viewers and Content Creator or any other contract which may exist between a Viewers and Content Creator, and are not responsible for any Viewer/Content Creator Transactions.
• Content Creators are responsible for determining the pricing applicable to Viewer/Content Creator Transactions and the Content to which you may be given access.
• Your payment gateway may charge you currency conversion fees. We do not have control over currency exchange rates or charges imposed by your payment card provider, bank or exchange and we and our subsidiary companies will not be responsible for paying any charges or fees imposed by your payment card provider, bank or exchange.
• The subscriptions in which you have subscribed to will take monthly periodic payments from your spending account. You authorize and consent to each of these payments being debited using your spending account.
• The viewer can cancel a Subscription however, the viewer will continue to be permitted to view the relevant Creator's Content until the end of the subscription period in which you cancelled if applicable, after which no further payments will be taken from your spending account in respect of subscriptions to that Creator's account (unless you choose to pay for a new Subscription to that Creator), and you will no longer be able to view the relevant Creator's Content.
• If the viewers payment method on record becomes invalid due to insufficient funds or other similar reasons and TheBenefactor.net is unable to charge the viewer on the next billing period, TheBenefactor.net may immediately revoke the viewers access to any paid service they have ordered until they update their payment method. If the viewer fails to update their payment method within a reasonable amount of time, TheBenefactor.net may cancel the viewers subscription.
• Refer to the Paid Services Terms to review the refund policy.
• The viewer agrees that they will not make unjustified requests for a refund in respect of any viewer/content Creator Transaction or tip to a Creator, or unjustified chargeback requests of your payment card provider in relation to any Viewer/Content Creator Transaction or tip to a Creator. If TheBenefactor.net considers that any request for a refund or chargeback request was made by the viewer in bad faith, TheBenefactor.net has the right to suspend or delete your Viewers account.
• If the viewer believes that TheBenefactor.net has charged them in error, they must notify TheBenefactor.net in writing no later than thirty (30) days after receiving the billing statement in which the error first appeared. If the viewer fails to notify the TheBenefactor.net in writing of a dispute within this thirty (30) day period, the viewer waives any right to dispute the charges. The viewer must submit any billing disputes by email to [email protected] and include a detailed statement describing the nature and amount of the disputed charges.

Please note: If TheBenefactor.net suspends a viewer's account in accordance with our rights under the Terms of Use, then any viewer payments, which would otherwise have fallen due during the period of suspension of the viewer, account will be suspended during the period of the suspension of the viewer account.

Verified Badge

 No Refunds - This applies for verified user fees, as these fees are immediately disbursed to Pay it Forward rewards to all enable users on TheBenefactor.net
• Wrongdoing - This applies for verified user, if any wrongdoing on your account arises ( deem able upon administrations findings ), your verified badge may be revoked for an indefinite period of time, and further actions may ensue.

Third party website/content

TheBenefactor.net allows content creators to link a number of different websites and social media profiles. A few are listed below:

TheBenefactor.net also allows the content creators to link third-party personal websites to their profile as long as the site does not violate TheBenefactor.net Terms of Use or any other Term or Policy.

TheBenefactor.net does not control or endorse any Third-Party Content and makes no representation of any kind regarding the Third-Party Content, including without limitation regarding its accuracy or completeness. The viewer are responsible for deciding if you want to access or use third-party websites or applications that link from TheBenefactor.net

Intellectual property rights

Other than User Content, TheBenefactor.net and its entire contents, features, and functionality ( Including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof ), are owned by TheBenefactor.net, our licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Other than User Content, no right, title, or interest in or to TheBenefactor.net or any content on TheBenefactor.net is transferred to you, and we reserve all rights not expressly granted. Any use of TheBenefactor.net not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws. If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of TheBenefactor.net in breach of the Terms, your right to use or access TheBenefactor.net will stop immediately and you must, at our request, return or destroy any copies of the materials you have made.

The viewer must not distribute, reproduce, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on TheBenefactor.net, except as follows:

• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

TheBenefactor.net respects the intellectual property of others and follows the requirements set forth in the 
Digital Millennium Copyright Act ( DMCA ) and other applicable laws. If you are the copyright owner or agent thereof and believe that content posted on TheBenefactor.net infringes upon your copyright, please submit a notice to [email protected] and outline concerns to be investigated by TheBenefactor.net's administration team.

Limitation of liabilities

TheBenefactor.net, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors will not be liable to you for any of the following:

1. Personal injury or property damage resulting from access to and use of TheBenefactor.net.
2. Unauthorized access to or use of the TheBenefactor.net servers and any personal or financial information stored in them, including unauthorized access to or changes to viewer and content creators account, submissions, transmissions, or data.
3. Errors, mistakes, or inaccuracies of content.
4. Account Content or any conduct by viewers or content creators that violates these Terms.
5. Interruption or cessation of transmission to or from TheBenefactor.net.
6. Bugs, viruses, Trojan horses, malware, ransomware, or other disabling code that may be transmitted to or through TheBenefactor.net by any person or that might infect your computer or affect your access to or use of TheBenefactor.net or your hardware or software.
7. Delays or failures you might experience in starting, conducting, or completing any transmissions to or transactions with TheBenefactor.net.
8. Incompatibility between TheBenefactor.net and your other services, hardware, or software.
9. Loss or damage incurred because of the use of any content posted, emailed, sent, or otherwise made available through TheBenefactor.net.

Unless caused by gross negligence or intentional misconduct, by TheBenefactor.net, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors will not be liable to you for any direct, indirect, special ( including so-called consequential damages ), statutory, punitive, or exemplary damages arising out of or relating to your access or your inability to access TheBenefactor.net or the content. This exclusion applies regardless of theory of liability and even if you told TheBenefactor.net about the possibility of these damages or TheBenefactor.net knew or should have known about the possibility of these damages.

If you are dissatisfied with TheBenefactor.net or have any other complaint, your exclusive remedy is to stop using TheBenefactor.net. The maximum liability of TheBenefactor.net and its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors to you for any claim will not exceed the greater of one hundred dollars ( $100 ) or the amount you have paid to TheBenefactor.net for the applicable purchase out of which liability arose even if the remedy fails in its essential purpose.

Releases

The viewer and/or content creators hereby release TheBenefactor.net, its subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, and directors from all liability arising out of User submissions or the conduct of other Users or third parties, including disputes between you and one or more other Users or third parties.

Scope of Disclaimers, Exclusions, and Limitations

The disclaimers, exclusions, and limitations stated herein apply to the greatest extent allowed by law, but no more. TheBenefactor.net does not intend to deprive the viewer or content creator of any mandatory protections provided to them by law. Because some jurisdictions may prohibit the disclaimer of some warranties, the exclusion of some damages, or other matters, one or more of the disclaimers, exclusions, or limits will not apply to them.

TheBenefactor.net reserves the right to amend any of the terms of these Terms of Service by posting the amended terms. Your continued use of TheBenefactor.net after the effective date of the revised Terms of Use constitutes your acceptance of the terms.

Proceedings are voluntarily dismissed or are dismissed as part of settlement of that dispute, neither party will be the prevailing party in those proceedings.

Both parties hereby waive the right to a trial by jury for any dispute arising out of or relating to TheBenefactor.net or these Terms. Either party may enforce this waiver up to and including the first day of trial. All claims must be brought in the party’s individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, and, unless the Company agrees otherwise, the arbitrator will not consolidate more than one person's claims. Both parties acknowledge that each party is waiving the right to participate in a class action.

A party will not file a claim arising out of or relating to TheBenefactor.net or these Terms more than one year after the cause of action arose. Any claim brought after one year is barred.

Miscellaneous

These Terms constitute the entire agreement between the viewer and/or content creator / user and TheBenefactor.net about your access to TheBenefactor.net. It supersedes all earlier or contemporaneous agreements between the viewer or content creator and TheBenefactor.net about access to TheBenefactor.net. A printed version of this agreement will be admissible in any proceedings arising out of ( or relating to ) these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and kept in printed form. Any additional terms on TheBenefactor.net will govern the items to which they pertain.

The parties may waive any provision in these Terms only by a writing signed by the party or parties against whom the waiver is sought to be enforced. No failure or delay in exercising any right or remedy, or in requiring the satisfaction of any condition, under these Terms, and no act, omission, or course of dealing between the parties, operates as a waiver or estoppel of any right, remedy, or condition.

Viewers and/or content creators / users may send notice to TheBenefactor.net by email at [email protected] unless a specific email address is set out for giving notice. TheBenefactor.net will consider an email notice received by TheBenefactor.net only when its server sends a return message to you acknowledging receipt. TheBenefactor.net may change its contact information on one or more occasions by posting the change on TheBenefactor.net Please check TheBenefactor.net periodically for the most current information for sending notice to TheBenefactor.net.

You consent to receiving any notice from TheBenefactor.net in electronic form either (1) by email to the last known email address the Company has for you, (2) a notification on your account, or (3) by posting the notice on a place on TheBenefactor.net chosen for this purpose.

TheBenefactor.net is not responsible for any failure to perform if unforeseen circumstances or causes beyond its reasonable control delays or continues to delay its performance, including: Acts of God, including fire, flood, earthquakes, hurricanes, tropical storms, epidemics, pandemics, or other natural disasters; war, riot, arson, embargoes, acts of civil or military authority, or terrorism; fiber cuts; strikes, or shortages in transportation, facilities, fuel, energy, labor, or materials; failure of the telecommunications or information services infrastructure; and hacking, spam, or any failure of a computer, server, network, or software.
